Abstract: In dispute after dispute in trial courts nationwide, real estate professionals are judged by triers of fact who reach conclusions without the benefit of a proper analysis of liability to support the expert witness’ opinion of performance. This article establishes the framework and methodology needed by consultants and expert witnesses involved in broker liability litigation.
