Force Majeure

    Tom Gates mentions this as one of the items tenants are bringing up.  So, I don’t want to take away from that discussion – please visit it also.

    But, I am curious about this one particular clause.  I have heard reported (obviously, 50/50 chance of being accurate at best) that China is using Force Majeure to cancel/get out of their contracts.  I know no specifics and haven’t researched this further.

    I am curious if anyone has dealt with this being used – particularly where it was a success.

    Is Covid-19 enough to trigger this clause?  If this is a legal question you don’t want to answer, I understand.  Anything you can provide as to what events in the past have met this clause would be helpful to all of us.  And if you aren’t a lawyer and just have an opinion as to this being a valid reason to use this clause, go for it.  I like opinions:)
