Abstract: There is great need and opportunity for redevelopment of brownfields, especially in urban areas. Such activity is impeded by fear of environmental liability. This article provides a useful survey of the many techniques available to manage that concern, including contractual allocation of environmental risk, new environmental insurance products, and many governmental initiatives to encourage brownfield reuse and redevelopment. The article recognizes the important impact of political and economic trends on this subject, and also provides a forecast under recent market conditions.
